PERM-Based EB-2 or EB-3 Petitions

I. Basic Requirements:

• Petitioner has to be a U.S. Company;

• For EB-2: You must have an advanced degree or its equivalent, which is a bachelor’s degree plus five years of progressive work experience in the field.

• For EB-3: You must have a bachelor’s degree or its foreign equivalent;

  1. PERM (permanent labor certification program) Application—Form ETA9089;

• PWD Prevailing Wage Determination

• Recruitment Activities

• 30-day Quiet Period

• Submit the form 9089

  2. I-140 Application, petition for an immigrant visa based on employment;
